First disputes received by Code adjudicators under the fifth edition of the Code

The first disputes to be raised by home buyers under the fifth edition of the Code have been reviewed by our Independent Dispute Resolution Scheme, two of which are now featured on our case study page.
The fifth edition was launched in January 2024. The highlighted cases relate to reservation agreements under the updated requirements. The claims succeeded in both cases.
Cancelled Reservation Agreement
The buyer complained that the builder cancelled the Reservation Agreement before it expired and gave inconsistent advice about part exchange.
The buyer asked for an apology, an explanation, an extended reservation expiry date and monetary compensation.
Deductions from Reservation Agreement
The buyer stated the builder had retained an unreasonable sum of money from the reservation fee paid following their withdrawal from the purchase and requested reimbursement.
The Case Studies section was launched in October 2024, with examples of real cases that have been through the IDRS to provide some useful learning points for home buyers, builders and sales agents.
